What’s the Difference between Gambling and Skill Games?

 

Gambling

Gambling must have all three of these elements:

  • Consideration – This is what you pay in order to play the game
  • Chance – The ability to win is random. You cannot control the outcome of an event.
  • Reward – This is what you win from the random event

Skill Games

A skill game, like Quick Draw Skill, eliminates the element of chance and requires a player to affect the outcome!

A player must use skill to win 104% of their play, every time they play.

Player Instructions

Amusement Games – The video games on this kiosk are for your amusement. You can win cash prizes on some plays, but the games are designed primarily for fun and
entertainment.

Skill and Dexterity are Required – To win, the player must exercise skill and dexterity to win a prize on each play of the game.

Game Features – On each play of the game, the player has the opportunity to win more than the cost of play. After the initial phase of each play, the player can press the “Pay Back” button and play a Simon-type game to win more than the cost of play. Also, each play of the game allows the player to preview the amount that he can win if he exercises enough skill and dexterity on that play of the game. Before playing, the player can press the “Preview” button to see the value of the next potential win. With these features, a Texas court has ruled that this type of video game is not a gambling device under Section 47.01 of Texas law.

Prizes – The table on the left-hand side of the screen shows all the available prizes.

End of Play – At the end of play, the player must press the “collect” button. The game will print a ticket with a QR code on it.

Claiming Prizes – The player must take the printed ticket to the PrimePay ticket redemption terminal that is located next to the game kiosk. The player must scan the QR code on the ticket, and the PrimePay terminal will dispense the cash prize.

Questions & Answers

1) Are the games legal? This game requires a Player to use his or her skill for the possibility of earning a cash reward. Because of this requirement: (1) this machine is NOT a gambling device, and (ii) the act of playing this machine IS NOT considered gambling under Texas law (see Tex. Penal Code §47.01 and §47.02). With skill the player can win every time.

2) How do you play the game? The object of the game is to get 3 like symbols in a row. The player can touch one square to make it wild. By making one square wild to create 3 in a row the customer will win.

3) How much do you win? It depends on the type of symbols that the player creates 3 in a row with. On the left side of the screen is a list of each symbol and how much the player wins for getting 3 in a row of that symbol. Max payout is $4,000.

4) How much can you Play? The player can play 25 points up to 400 points, each point is worth a penny. On the bottom of the screen is a button to increase or decrease how much they are playing per game.

5) How do you claim winnings from the game? When the player is done playing, on the bottom left of their game screen, they can press an icon on the screen for “More Games”, then at the top left of the screen is an icon to “Redeem”. This will print out the customers receipt for their winnings.

6) How do you get your money? The Player will take their receipt to the TRT (Ticket Redemption Terminal), usually next to the games. They will press “Redeem” and then scan the QR code on their ticket. The TRT will dispense their cash.

7) What happens if the machine runs out of printer paper or the printer jams? Contact an attendant in the facility, and they will be able to service the machine or contact the operator.

8) How do you prevent under aged people from playing the games? Winnings are only paid out to individuals that have a government issued ID proving they are over the age of 18.
